App - Privacy Policy

The Company recognises the importance of maintaining the privacy of the information belonging to you. This Policy sets out details of how we treat user information we collect on this Mobile Application. The Application is owned and operated by Asianxt Digital Technologies Private Limited (Formerly known as Asianet News Media & Entertainment Private Limited), a private limited company registered under the provisions of the [Indian] Companies Act 2013 having its registered office at No. 36, Crescent Road, Bangalore 560 001, Karnataka, India (the “Company” or “We”).

Your privacy is our top priority. By visiting and/or using the Application, you agree to the terms of this Privacy Policy, and it shall be deemed that you have read in full, accepted and agreed to the terms herein. The Company reserves the right to modify the terms contained in this Privacy Policy at any time by posting such modifications on the Application. The modified Privacy Policy would be effective from the date of modification that is posted by the Company on the Application. If you do not agree to any term that is contained in this Privacy Policy, please immediately cease your use of the Application.

Information that is collected by the Company on the Application shall be used by the Company only for the purpose of providing the news and entertainment related content and information on the Application (the “Content”), and such information shall not be used, sold, transferred or rented in a manner that is not set out in this Privacy Policy.

The Application is primarily a News application. Users can consume news content without logging in. Login is optional and required only for accessing creator-related features.

Information may be collected in several ways:

In providing the various services that are available on the Application (the “Services”), the Company may have to collect certain personal information from you. This information would, inter alia, include the following:

Active collection: This refers to the information that is actively provided by you while browsing the Application, while sharing Content (by using the share button on the Application) to social media applications or making comments on the Application etc. This would also include information relating to yourself that you would be providing on the Application to avail the Services.

Passive Collection: This refers to the information that is gathered by the Company using tracking tools like Google Analytics, Google Webmaster, browser cookies etc. for collecting information about your usage of our Application. This information may be used by the Company for internal research to understand User demographics, interests and behaviour with a view to improving the functionality of the Application. This information may include the URL of the Application that you visited just before visiting the Application or which one you go to after visiting the Application, your computer browser information, and your IP address.

The Application may use the Content (or any part thereof) for AI training models and to improve the systems, features and functionality of the services provided on the Application.

While the Company does not actively collect any information from persons who visit the Application, but do not register themselves on it or avail of the Services, certain portions of this Privacy Policy would be applicable to such visitors as well.

In making available the Content on the Application, the Company may have to collect certain personal information from you. This information would, inter alia, include the following:

Contact information: the Company may collect your name, email, mobile number, postal address, IP address, Device ID, SMS for OTP etc.

Interests and other data necessary to use the App: In order for you to use the Application and the services provided on the Application, the Company will receive information of your user name, location (GPS enabled user Location/ nearest prominent address), nature of the device used by you (applicable only on the Android version of the App), your age, language, your interests as shared by you on the App, your title / designation (optional) and your biography (optional details).

Other information: While you use the Application, the Company may collect information about your geographical location, IP address, browser type, operating system, referral source, length of visit and nature of the Content viewed, Application navigation, pixel tag etc.

The Application requests permissions only when needed, based on your actions in the Application.

• Camera: To record videos for creator content. Accessed only when you choose to create a video.
• Media / Storage: To upload videos and save drafts. Limited to content you explicitly select.
• Approximate Location: To provide relevant news and content suggestions. Only approximate location is collected.
• SMS Auto-Detection: For OTP verification during login. Strictly limited to OTP messages; no other SMS are accessed.
• Analytics & Device Data: To improve Application performance and user experience. Only anonymous or aggregated analytics; no personal data collected without consent.

You acknowledge and agree that any and all information that is provided by you on the Application is provided by you voluntarily and at your own risk. While the Company would make all efforts to ensure the safety and security of the information provided for you, it shall not be responsible for any loss or theft of data. Please note that any information that is provided by you may be retained by the Company for (i) providing the access to the Content in a manner that is preferred by you; and (ii) for meeting its obligations under applicable law. [Even if you delete your User account on Application, the Company may have to retain the information provided by you for a short period of time until the same can be removed from its servers, and for compliance with its obligations under law (if any).]

You shall be responsible for the accuracy of the information provided to the Company for the use of the Application. If there is any mistake in or change to the personal information provided by you for the use of Application, you shall immediately notify the Company at feedback@asianetnews.in. You shall be solely liable for the consequences of providing incomplete, inaccurate or incorrect information on the Application. Where the Company has reasons to believe that the information provided by you on the Application is incorrect or incomplete, the Company may restrict you from using the Application by disabling your User Account.

If you want to discontinue the use of the Application, or if you want to withdraw the consent granted to the Application for collecting and processing your data, please notify the Company at feedback@asianetnews.in. Once you discontinue the use of the Application or withdraw your consent, the Company shall retain the personal information provided by you on the Application for such time period as may be mandated by applicable law and thereafter erase the same in full.

Creator features are optional and include:

• Public visibility of creator profiles
• Public display of uploaded videos post moderation
• Content Publishing: Videos are public only after moderation to ensure compliance with guidelines.

Content Moderation & Reporting:

• Users can report inappropriate content via the Application.
• We may remove content that violates our guidelines or applicable laws.

• Login is optional: News content is fully accessible without logging in.
• Permissions are requested contextually and only after explicit user action.

Personal data and uploaded content are retained while your account exists.

If you have entered and saved any information on the Application, you can request that we rectify or erase any personal data we hold about you. Please send your request to feedback@asianetnews.in.

Updating your account information: If you have an account, you may be able to review the information you provided to us by logging into your account page and adjusting the settings under the “Account”.

Email communications: If you receive an unwanted email from us, you can update your preferences by accessing the email preferences in your account settings page, or you can notify us at feedback@asianetnews.in.

Telephone/Text communications: If you receive an unwanted call or message from us, you can update your preferences by requesting to us at the following email address feedback@asianetnews.in.

Deletion or Other Request: To request deletion of your information or for another request regarding your information, please send an email to feedback@asianetnews.in. We will respond to your request within a reasonable timeframe, or otherwise in accordance with applicable law. We will retain your information for as long as your account is active or as needed to provide you the Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Public Content (Videos): Uploaded videos associated with your account may remain on the Application at the Company’s discretion, even after your account is deleted.

In some cases, videos may be anonymized or removed based on moderation or business requirements.

To provide the Services: We use the information shared by you on the Application to provide you with the Services. We would also use such information to register you on the Application and display your profile for access by other Users of the Application.

We encourage you to consider and evaluate carefully about the nature and extent of the information you disclose about yourself on the Application. We also do not recommend that you put sensitive data such as email addresses, phone numbers, full names or addresses, credit card details, drivers’ licence details etc. on your profile since such data is critical and may be open to abuse and misuse. Any personal information that you share with other Users on the Application is at your own risk.

To contact you: The contact information you provide would be used by the Company to contact you in relation to the provision of the Services. We would also use it to communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the App, and for marketing and promotional purposes.

Moderation Policy: We use a combination of automated systems and a team of moderators to monitor and review accounts (including photos, audio clips, chats and any other information uploaded onto user profiles) and messages for content that indicates breaches of our Terms of Use or Privacy Policy. Users may flag any Content via the 'report' feature available on the App. The Company will thereafter review the flagged Content and take the necessary action. If an account or message meets certain criteria that demonstrate that the Terms and Conditions of Use are likely to have been breached, the relevant account will be subject to a warning and the user’s access restricted and/or blocked.

If you post anything that is inconsistent with our Terms of Use or Privacy Policy, we reserve the right to terminate or restrict access to your account.

To improve the quality of the Content: The Company might use your information to improve the functionality of the Application and the Content as well as the manner in which it is presented.

For security purposes: The Company might use the information provided by you on the Application to protect our company, our customers, or our applications.

For marketing purposes: The Company might send you information about new Content on the Application or notify you of new or improved features on the Application. The Company might also notify you of new or improved features on the App.

Transactional communications: The Company may also contact you by way of emails or SMSs to keep you informed of the various actions taken by the Company in the course of providing the Services.

The Company shall use your information only in a manner that is permitted by applicable law.

Each User who has provided a consent to the Company for the processing of his/her data shall have the following rights:

• A right to obtain from the Company a summary of the personal data processed by the Company and the processing activities undertaken by the Company with respect to such data; and
• The identities of all other entities and processors with whom the personal data of the User has been shared, along with a description of the personal data so shared.

Compliance with law: The Company might share your information to respond to a court order or subpoena. The Company may share your information if a government agency or investigatory body requests the Company to do so.

Mergers and Acquisitions: If the Company sells its business or hives of a portion of the same to a new entity, your personal information that is available on the Application may be transferred to the new entity.

Please note that neither the Company nor any of its employees would have access to the password that relates to your User account on the Application. You shall be solely responsible for protecting your login credentials to the Application, and the Company shall not be liable in any manner for unauthorised use of your login credentials. You shall be liable to the Company for any loss suffered by the Company as a result of unauthorised use of your login credentials. In the event of any misuse or suspected misuse of the same, please notify the Company at feedback@asianetnews.in.

While the Company shall seek to implement the best market practices and security policies for the protection of your personal information, it shall not be liable for improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. It is expressly stated that the Company shall not be responsible for any breach of security or for any actions of any third parties that receive Users' personal data or events that are beyond the reasonable control of the Company including, acts of government, computer hacking, unauthorized access to computer data and storage devices and storage technology, hardware, computer crashes, breach of security and encryption etc.

Cookies: A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you grant the permission, the file is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. The Company uses traffic log cookies to identify which pages are being used. This helps the Company analyze data about web page traffic and improve the functioning of the Application. This information is used by the Company only for statistical analysis and then the data is removed from the system. Please note that the Company does not have any control over the cookies that are placed by third party links on the Application. The Company does not represent to you that such third-party Applications have their own Privacy Policies or that the information that is provided by you to them would be secure.

When you visit the Application, your name and email address may be saved in cookies. These are for your convenience so that you do not have to fill in your details again when your session is active. These cookies will be saved on your computer until you delete them.

If you click on one of the links to third party Applications that may be available on the Application, you may be taken to Applications that the Company does not control. This Privacy Policy does not apply to the privacy practices of those Applications.

The Company shall not be liable for the misuse of your personal information by third party Applications.

The Company may use third-party advertising companies to serve ads when a User visits the Application, mobile application or services. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other Applications in order to provide advertisements about goods and services of interest to you.

Services may include links to other Applications or applications. Such Applications or applications are governed by their respective privacy policies and are beyond our reasonable control. Once you leave our server (you can recognize your location by checking the URL in location bar on your browser), any kind of information provided by you is governed by the privacy policy of the operator of the applications/Application(s) you are visiting. Their policy may differ from ours. If you can't find the privacy policy of any of these applications/Applications via a link from the application's homepage, you should contact the application owner(s) directly for more information.

Presentation of information to our advertisers for helping them to understand our audience(s) and to know the value of advertising on our Applications or applications, is usually in form of aggregated statistics on traffic to various pages / content within our Applications or Applications.

We do not provide any personally identifiable information to any third party Applications / advertisers / ad-servers without obtaining your consent.

This Agreement and the Services provided by the Application are available to any person over the age of eighteen (18) years who registers on the Application in the manner provided herein. Persons below the age of eighteen (18) shall not be entitled to use the Application or the Services, unless such use is through the User account of a parent or legal guardian.

If Company becomes aware that any personally identifiable information of persons less than 18 years of age has been collected on the Application without verified parental consent, then the Company will take the appropriate steps to delete any such information and notify the parent. However, we consider it the responsibility of parents to monitor their children’s use of our services. Nevertheless, it is our policy not to collect and process any personal information from children below 18 years of age or offer to send any promotional materials to persons in that category. The Company does not seek or intend to seek or receive any personal information from children. Should a parent or guardian have reasons to believe that a minor has provided Company with personal information without their prior consent, please contact our customer support team to ensure that the personal information is removed from the Company.

If a User has any questions or grievances regarding the Application, the contents thereof, the manner in which personal data is being collated or processed by the Application or regarding the Services, the User may reach out to the designated Grievance Officer of the Company at grievance@asianetnews.in (the “Grievance Officer”), details as below:

The Grievance Officer shall address any complaint or grievance that is raised by a User within a period of fifteen (15) days from when it is raised.

Where the Company requires additional information to process and respond to the query raised by a User, the Company shall notify the User of the same.

• E-mail address

Force Majeure. The Company shall not be responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott, lockdown or pandemic. The Company may at any time, in its sole discretion and without advance notice to you, cease operation of the Application and the provision of the Services.

No Waiver. A delay or failure by the Company to exercise or enforce any right or provision of this Privacy Policy will not constitute a waiver of such right or provision.

Notices: All notices given to a User by the Company or by a User to the Company or another User shall be in writing and in the English language. Such notice shall be sent by e-mail or mailed by a prepaid internationally-recognized courier service to the intended recipient at the address set out below, or any changed address that is notified by either Party: Notice to the Company:

Governing Law; Jurisdiction. This Privacy Policy is governed by the provisions of [Indian] laws. This Application originates from the State of Karnataka in India. This Privacy Policy will be governed by the laws that are applicable in the State of Karnataka. By using this Application, you consent to the jurisdiction and venue of the courts located in Karnataka, India in connection with any action, suit, proceeding or claim arising under or by reason of this Privacy Policy.
