Asianxt Digital Technologies Private Limited (formerly known as Asianet News Media & Entertainment Private Limited), a private limited company registered under the provisions of the [Indian] Companies Act, 2013 and having its registered office at No. 36, Crescent Road, Bangalore 560 001, Karnataka, India (the “ Company ”), recognises the importance of maintaining the privacy of your personal information and is committed to protecting it in accordance with applicable law.

This privacy policy (the “ Privacy Policy ”) sets out details of how the Company collects, uses, stores, discloses and otherwise processes your personal information when you access or use this mobile application titled “ Asianxt ” (and/or any other website of the Company, operated in connection with the mobile application; the “ Application ”).

The Application serves as a multi-feature digital platform that offers users the following services (the “ Services ”):

• News and Entertainment Services: Users may access news, current affairs, and entertainment content available on the Application without creating an account or logging in;
• Creator Services: Users who register on the Application as creators (the “ Creators ”) may upload, publish and share original audio-visual and other content on the Application (the “ Content ”). Content uploaded by Creators may, subject to the terms of the Content Partnership Agreement at https://asianxtcreators.asianetnews.com/aggregator/tempAgreement and other terms of the Company, as applicable, be reshared or republished by the Company on its other owned and operated platforms, including other social media handles; and
• User Services: Users who register on the Application as users and not Creators may browse, scroll, follow Creators and interact with content published on the Application.

Your privacy is our top priority. By visiting, accessing, and/or using the Application, you acknowledge that you have read in full, understood, and agree to the terms of this Privacy Policy.

The Company reserves the right to modify the terms contained in this Privacy Policy at any time by posting such modifications on the Application. The modified Privacy Policy would be effective from the date such modification is posted by the Company on the Application. Your continued use of the Application following the posting of a modified Privacy Policy shall constitute your acknowledgement of and agreement to such updated Privacy Policy. If you do not agree to any term that is contained in this Privacy Policy at any point in time, please immediately cease your use of the Application.

Personal information collected by the Company on the Application shall be used by the Company in accordance with the provisions of this Privacy Policy, for the purpose of providing the Services, and such information shall not be used, sold, transferred or rented in a manner that is not set out in this Privacy Policy.

Information may be collected in several ways:

In providing the Services, the Company may collect certain personal information from you. This information would, inter alia, include the following:

Active collection: This refers to the information that is actively provided by you when you use the Application, including when you register for an account on the Application, upload or publish Content, share Content to any third-party social media platforms, make comments on the Application, follow other Creators, or otherwise interact with the Application or its features. This would also include information relating to yourself that you would be providing on the Application to avail the Services.

Passive Collection: This refers to the information that is gathered by the Company using tracking tools like Google Analytics, Google Webmaster, browser cookies, etc., for collecting information about your usage of the Application. This information may be used by the Company for internal research to understand User demographics, interests, and behaviour with a view to improving the functionality of the Application. This information may include the URL you visited just before visiting the Application and the URL you navigate to after visiting the Application, your device and browser information, your IP address, and your usage patterns on the Application, including pages visited, content viewed and time spent.

The Company may use the above information or the Content (or any part thereof) for training artificial intelligence or machine learning models and to improve the systems, features and functionality of the Services provided on the Application.

In making the Services available on the Application, the Company may collect the following categories of personal information from you:

Contact information: the Company may collect your name, email, mobile number, postal address, IP address, Device ID, mobile number etc.

Interests and other data necessary to use the App: In order for you to use the Application and the Services provided on the Application, the Company will receive information of your user name, location (GPS enabled user location nearest prominent address), nature of the device used by you (applicable only on the Android version of the Application), your age, language, your interests as shared by you on the Application, your title/designation (optional) and your biography (optional).

Other information: While you use the Application, the Company may collect information about your geographical location, IP address, browser type, operating system, referral source, length of visit, and nature of the Content viewed, Application navigation, pixel tag, etc.

The Application requests permissions only when needed, based on your actions in the Application.

• Camera: To record videos for Creator Content. Accessed only when you choose to create a video.
• Media/Storage: To upload videos and save drafts. Limited to content you explicitly select.
• Approximate Location: To provide relevant news and Content suggestions. Only approximate location is collected.
• Microphone Access: To enable voice-based prompting features within the Application. Accessed only when you choose to use voice-enabled functionality.
• SMS Auto-Detection: For OTP verification during login. Strictly limited to OTP messages; no other SMS are accessed.
• Analytics & Device Data: To improve Application performance and user experience. Only aggregated analytics and no identifiable personal data is collected without consent.

Asianxt may use your data to deliver personalized content and targeted advertisements relevant to your interests. Asianxt accesses this information on an aggregated basis for broad analytical reporting and an individual basis to maintain your personal preferences and account features. We do not sell your identifiable data to third parties for their own independent marketing purposes.

You acknowledge and agree that any and all information that is provided by you on the Application is provided by you voluntarily and at your own risk. While the Company would make all efforts to ensure the safety and security of the information provided for you, it shall not be responsible for any loss or theft of data. Please note that any information that is provided by you may be retained by the Company for (i) providing access to the Services in a manner that is preferred by you; and (ii) for meeting its obligations under applicable law. Even if you delete your user account on Application, the Company may have to retain the information provided by you for such period of time, in compliance with its obligations under applicable law (if any).

You shall be responsible for the accuracy of the information provided to the Company for the use of the Application. If there is any mistake in or change to the personal information provided by you for the use of the Application, you shall immediately notify the Company at feedback@asianetnews.in. You shall be solely liable for the consequences of providing incomplete, inaccurate or incorrect information on the Application. Where the Company has reasons to believe that the information provided by you on the Application is incorrect or incomplete, the Company may restrict you from using the Application by disabling your user account.

If you wish to discontinue the use of the Application, or withdraw the consent granted to the Company for collecting and processing your personal data, you may notify the Company of the same by writing to feedback@asianetnews.in, or through the account settings on the Application, where such functionality is made available. Once you discontinue the use of the Application or withdraw your consent, the Company shall retain the personal information provided by you on the Application for such period as may be mandated by applicable law and thereafter erase the same in full. Please note that withdrawal of consent for certain categories of processing may affect your ability to access or use all or part of the Services.

While exercising your rights under this Privacy Policy, you agree to:

• Provide only authentic and verifiable information to the Company;
• Not impersonate another person while providing personal data;
• Not register false or frivolous grievances or complaints with the Company or the Data Protection Board; and
• Ensure that you do not suppress any material information while providing details for proof of identity.

Creator features are optional and are available only to users who choose to register as Creators on the Application by signing up to the Content Partnership Agreement.

By registering as a Creator, you acknowledge and agree to the following:

• Public visibility of creator profiles;
• Public display of uploaded videos post moderation; and
• Videos are public only after moderation to ensure compliance with guidelines.

The Company uses the personal information collected from you for the following purposes:

To Provide the Services: The Company uses your personal information to provide you with the Services, including to register you on the Application, display your profile for access by other users of the Application, enable you to upload and publish Content as a Creator, enable you to browse and follow Content as a consumer, and to facilitate your use of all features available on the Application. We encourage you to consider and evaluate carefully the nature and extent of the information you disclose about yourself on the Application. We specifically advise against putting sensitive data such as email addresses, phone numbers, full names or addresses, credit card details, drivers’ licence details, etc. on your profile since such data is critical and may be open to abuse and misuse. Any personal information that you share with other users on the Application is at your own risk.

To contact you: The contact information you provide would be used by the Company to contact you in relation to the provision of the Services. The Company would also use it to communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the Application. Where you have consented to receiving marketing communications, the Company will also use your contact information to notify you of new Content, features, or improvements on the Application. You may withdraw your consent to receiving marketing communications at any time by updating your preferences in your account settings or by writing to us at feedback@asianetnews.in.

Content Moderation: The Company use a combination of automated systems and a team of moderators to monitor and review accounts (including photos, audio clips, chats, and any other information uploaded onto user profiles) and messages for content that indicates breaches of the Company’s Terms of Use, Community Guidelines, UGC Moderation Policy, this Privacy Policy, any other policy, or applicable law. Users may flag any Content via the ‘report’ feature available on the Application. The Company will thereafter review the flagged Content and take the necessary action. If an account or message meets criteria indicating a likely violation of the Company’s Terms of Use, Community Guidelines, this Privacy Policy, any other policy, or applicable law, the relevant account will be subject to a warning, and the user’s access will be restricted and/or blocked. If you post anything that is inconsistent with our Terms of Use, Community Guidelines, this Privacy Policy, any other policy, or applicable law, we reserve the right to terminate or restrict access to your account.

To improve the quality of the Content: The Company may use your information to improve the functionality of the Application and the Content, as well as the manner in which it is presented.

For security purposes: The Company may use the information provided by you on the Application to protect the security and integrity of the Application, the Company, and its users, including to detect, investigate and prevent fraudulent, unauthorised or unlawful activity on the Application.

For marketing purposes: Where you have consented to receiving marketing communications, the Company may use your information to send you information about new Content on the Application or notify you of new or improved features on the Application.

Transactional communications: The Company may also contact you by way of emails or SMSs to keep you informed of the various actions taken by the Company in the course of providing the Services.

The Company shall use your information only in a manner that is permitted by applicable law.

Each user whose personal information is processed by the Company in accordance with this Privacy Policy shall have the following rights with respect to their personal information:

Right to Information

You shall have the right to obtain from the Company:

• a summary of the personal data processed by the Company and the processing activities undertaken by the Company with respect to such data;
• the identities of all other entities and processors with whom the personal data of the user has been shared, along with a description of the personal data so shared; and
• any other information relating to your personal data and its processing that you are entitled to under applicable law.

Right to Correction and Erasure

You have the right to request the Company:

• To correct any personal data held by the Company that is inaccurate or incomplete; and
• To erase your personal data where such data is no longer necessary for the purpose for which it was collected, where you have withdrawn your consent and there is no other legal basis for processing, or where processing is otherwise unlawful.

Requests for correction or erasure may be submitted to the Company at feedback@asianetnews.in. The Company will respond to and give effect to such requests within a reasonable period, subject to its obligations to retain data under applicable law as described in this Privacy Policy.

Right to Withdraw Consent

Where the Company processes your personal data on the basis of your consent as granted by you in accordance with this Privacy Policy, you have the right to withdraw such consent at any time. Withdrawal of consent may be effected by writing to the Company at feedback@asianetnews.in or through the account settings on the Application where such functionality is made available. Withdrawal of consent will not affect the lawfulness of any processing carried out prior to such withdrawal. Please note that withdrawal of consent for certain categories of processing may affect your ability to access or use all or part of the Services.

Right of Nomination

You have the right to nominate, in the manner prescribed under the DPDP Act, another individual who shall, in the event of your death or incapacity, exercise your rights in respect of your personal data in accordance with applicable law.

Email communications: If you receive an unwanted email from us, you can update your preferences by accessing the email preferences in the account settings page on the Application, or you can notify us at feedback@asianetnews.in.

Telephone/Text communications: If you receive an unwanted call or message from us, you can update your preferences by contacting us at feedback@asianetnews.in.

How to Exercise Your Rights

To exercise any of the rights described above, you may:

• write to the Company at feedback@asianetnews.in; or
• contact the Grievance Officer at the details set out in this Privacy Policy.

Limitation of Rights

The exercise of the rights described above is subject to the Company’s obligations under applicable law, including its obligations to retain data for specified periods as described in this Privacy Policy, and to comply with court orders and directions of competent authorities.

Force Majeure. The Company shall not be responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott, lockdown or pandemic. The Company may at any time, in its sole discretion and without advance notice to you, cease operation of the Application and the provision of the Services.

No Waiver. A delay or failure by the Company to exercise or enforce any right or provision of this Privacy Policy will not constitute a waiver of such right or provision.

Notices: All notices given to a user by the Company or by a user to the Company shall be in writing and in the English language. Such notice shall be sent by e-mail or mailed by a prepaid internationally-recognised courier service to the intended recipient at the address set out below, or any changed address that is notified by either Party:

Governing Law; Jurisdiction. This Privacy Policy is governed by the provisions of the laws of India. You hereby consent to the exclusive jurisdiction and venue of the courts located in Bengaluru, Karnataka, India, in connection with any action, suit, proceeding or claim arising under or by reason of this Privacy Policy.
